The vaping reforms introduced Commonwealth controls across vaping devices, vaping device accessories, vaping substances and substance accessories. The statutory definitions and particular instruments should be consulted where classification is uncertain. The description on a product listing is not determinative: “nicotine-free”, “dry herb” or “replacement part” does not settle the legal position without examining the nature and intended use of the goods.
Therapeutic vapes for smoking cessation
This category is concerned with smoking cessation and management of nicotine dependence. The TGA's notified vape list identifies certain goods notified as meeting relevant conditions for lawful prescription and supply. Importantly, the TGA states these notified products are not included in the ARTG and have not been evaluated by the TGA for quality, safety, efficacy or performance. Notification and formal ARTG inclusion are different concepts.
