In Australia, therapeutic vaping goods for smoking cessation or the management of nicotine dependence are supplied through a regulated pharmacy pathway. That does not make vaping goods ordinary pharmacy retail products, and it does not mean a pharmacy may advertise them freely to the public.
Why the pharmacy pathway exists
The Commonwealth vaping reforms preserve controlled clinical access to certain therapeutic vaping goods while limiting non-therapeutic supply. The TGA states that lawful supply is through pharmacies, subject to product standards, professional assessment and state or territory requirements. Participating pharmacists must apply their professional judgement and are not obliged to supply a vape merely because a person requests one.
Prescription and pharmacist-led access
The precise supply pathway can depend on age, nicotine strength, clinical circumstances, prescription status and the law of the relevant state or territory. The TGA describes conditions for certain adults aged 18 or over to access lower-strength therapeutic nicotine products without a prescription where local laws and pharmacist requirements permit. The notified vape list is not ARTG approval
The TGA's notified vape list identifies products whose sponsors have notified compliance with applicable requirements. The TGA cautions that these goods are not included in the ARTG and have not been evaluated by the TGA for safety, quality, efficacy or performance. Pharmacies are directed to verify the goods they stock against the relevant requirements, including current notified-list conditions and product standards.
Supply, privacy and advertising are separate questions
Pharmacy supply obligations encompass more than displaying a product. They may involve patient assessment, counselling, relevant documentation, product presentation, secure handling and professional standards. Communications directly with a patient may be authorised in defined treatment circumstances, but general public promotion remains subject to the vaping advertising prohibition.
