Australian restrictions on vaping advertisements apply to social media as well as traditional advertising. A sponsored post, influencer endorsement, product tag or promotional video can be relevant even where the platform does not process a sale.
Promotions are not limited to purchased advertising
The TGA's advertising definition includes statements, images and designs intended directly or indirectly to encourage the use or supply of vaping goods. Paid campaign status is not required. Promotional reels, creator collaborations, brand posts, product showcases and public product referrals may fall within the prohibition depending on content and context.
Influencers and testimonials
The TGA's vaping advertising guidance identifies restrictions on testimonials and endorsements even in the limited circumstances where communications are authorised. A personal account declaring a particular vape superior, enjoyable or suitable for someone else can have advertising characteristics, particularly if connected with a brand or retailer. The presence of an affiliate arrangement strengthens the commercial context but is not the sole factor.
Educational-looking posts
A post about legal changes or device terminology may be informative; however, the surrounding account, captions, hashtags, product tags and destination links contribute to its overall impression. Labelling a post “for educational purposes” is not decisive. The TGA's 2026 guidance expressly considers direct and indirect promotion across different forms of communication.
Checking social media information
Treat broad claims such as “completely legal in Australia” or “approved for everyone” with caution. Australia distinguishes types of vaping goods and clinical pathways. Official TGA pages and the Federal Register are more dependable sources for the legal framework than brief social posts that omit category, date or local restrictions.
